Article L242-16 of the French Consumer Code

Any breach of the provisions of articles L. 223-1 to L. 223-5 is punishable by an administrative fine of up to €75,000 for a natural person and up to €375,000 for a legal entity.
This fine is imposed under the conditions set out in Chapter II of Title II of Book V.

By way of derogation from the first paragraph of Article L. 522-6, the decision handed down pursuant to this article by the administrative authority responsible for competition and consumer affairs is published at the expense of the person penalised.

The administrative authority responsible for competition and consumer affairs may decide to postpone publication of a decision, to publish it anonymously or not to publish it in any of the following circumstances:

1° Where publication of the decision is likely to cause serious and disproportionate harm to the person concerned;

2° Where publication would be likely to seriously disrupt the course of an investigation or control in progress.

Tout manquement aux dispositions des articles L. 223-1 à L. 223-5 est passible d’une amende administrative dont le montant ne peut excéder 75 000 € pour une personne physique et 375 000 € pour une personne morale.
Cette amende est prononcée dans les conditions prévues au chapitre II du titre II du livre V.

Par dérogation au premier alinéa de l’article L. 522-6, la décision prononcée en application du présent article par l’autorité administrative chargée de la concurrence et de la consommation est publiée aux frais de la personne sanctionnée.

L’autorité administrative chargée de la concurrence et de la consommation peut décider de reporter la publication d’une décision, de publier cette dernière sous une forme anonymisée ou de ne pas la publier dans l’une ou l’autre des circonstances suivantes :

1° Lorsque la publication de la décision est susceptible de causer à la personne en cause un préjudice grave et disproportionné ;

2° Lorsque la publication serait de nature à perturber gravement le déroulement d’une enquête ou d’un contrôle en cours.
