Article L312-3 of the French Sports Code

The total or partial removal of a private sports facility, the financing of which has been provided by one or more legal entities governed by public law for at least a percentage set by decree in the Conseil d’Etat, as well as the change in its use, are subject to the authorisation of the legal entity governed by public law that has participated alone or has participated for the largest part in this financing. The opinion of the mayor of the municipality in which the facility is located is attached to the application for authorisation.

This authorisation is subject to the condition that the facility is replaced by an equivalent sports facility.

Any change of use in the absence of authorisation automatically entails the repayment of all subsidies received to the public legal entity or entities mentioned in the first paragraph. A decree sets out the conditions for application of this paragraph.

Article L312-3

La suppression totale ou partielle d’un équipement sportif privé dont le financement a été assuré par une ou des personnes morales de droit public pour une partie au moins égale à un pourcentage fixé par décret en Conseil d’Etat ainsi que la modification de son affectation sont soumises à l’autorisation de la personne morale de droit public ayant participé seule ou ayant participé pour la plus grande part à ce financement. L’avis du maire de la commune où est implanté l’équipement est joint à la demande d’autorisation.

Cette autorisation est subordonnée à la condition que cet équipement soit remplacé par un équipement sportif équivalent.

Toute modification d’affectation en l’absence d’autorisation entraîne de droit le reversement à la personne ou aux personnes morales de droit public mentionnées au premier alinéa de l’ensemble des subventions perçues. Un décret fixe les conditions d’application du présent alinéa.
