Article L313-47 of the French Consumer Code

The borrower may always, on his own initiative, repay in advance, in part or in full, the loans governed by sections 1 to 5 of this chapter. The loan agreement may prohibit repayments equal to or less than 10% of the initial amount of the loan, except in the case of its balance.

If the loan agreement includes a clause under which, in the event of early repayment, the lender is entitled to demand compensation in respect of interest not yet due, this may not, without prejudice to the application of Article 1231-5 civil code, exceed an amount which, depending on the remaining term of the contract, is set according to a scale determined by decree.

The lender shall provide the borrower, free of charge and without delay after receipt of the request for early repayment, on paper or on another durable medium, with the information required to examine this option. This information shall at least quantify the consequences that will be imposed on the borrower if he fulfils his obligations before the expiry of the credit agreement and shall clearly formulate the assumptions used.

L’emprunteur peut toujours, à son initiative, rembourser par anticipation, en partie ou en totalité, les prêts régis par les sections 1 à 5 du présent chapitre. Le contrat de prêt peut interdire les remboursements égaux ou inférieurs à 10 % du montant initial du prêt, sauf s’il s’agit de son solde.

Si le contrat de prêt comporte une clause aux termes de laquelle, en cas de remboursement par anticipation, le prêteur est en droit d’exiger une indemnité au titre des intérêts non encore échus, celle-ci ne peut, sans préjudice de l’application de l’article 1231-5 code civil, excéder un montant qui, dépendant de la durée restant à courir du contrat, est fixé suivant un barème déterminé par décret.

Le prêteur fournit gratuitement sans tarder à l’emprunteur, après réception de la demande de remboursement par anticipation, sur support papier ou sur un autre support durable, les informations nécessaires à l’examen de cette faculté. Ces informations chiffrent au moins les conséquences qui s’imposeront à l’emprunteur s’il s’acquitte de ses obligations avant l’expiration du contrat de crédit et formule clairement les hypothèses utilisées.
