The borrower may always, on his own initiative, repay in advance, in part or in full, the loans governed by sections 1 to 5 of this chapter. The loan agreement may prohibit repayments equal to or less than 10% of the initial amount of the loan, except in the case of its balance.
If the loan agreement includes a clause under which, in the event of early repayment, the lender is entitled to demand compensation in respect of interest not yet due, this may not, without prejudice to the application of Article 1231-5 civil code, exceed an amount which, depending on the remaining term of the contract, is set according to a scale determined by decree.
The lender shall provide the borrower, free of charge and without delay after receipt of the request for early repayment, on paper or on another durable medium, with the information required to examine this option. This information shall at least quantify the consequences that will be imposed on the borrower if he fulfils his obligations before the expiry of the credit agreement and shall clearly formulate the assumptions used.
