Article L3142-26 of the French Labour Code

In order to implement an employee’s right to the leave referred to in Article L. 3142-16, a branch agreement or convention or, failing that, a company agreement or convention shall determine:

1° The maximum duration of the leave ;

2° The number of possible renewals ;

3° The time limits for informing the employer by the employee of the taking of the leave and its renewal, as well as the length of the notice period in the event of the employee’s return before the end of the leave;

4° The deadlines for the employee’s request and the employer’s response regarding the splitting of the leave or its conversion into a period of part-time work.

Pour mettre en œuvre le droit à congé du salarié mentionné à l’article L. 3142-16, une convention ou un accord de branche ou, à défaut, une convention ou un accord collectif d’entreprise détermine :

1° La durée maximale du congé ;

2° Le nombre de renouvellements possibles ;

3° Les délais d’information de l’employeur par le salarié sur la prise du congé et son renouvellement ainsi que la durée du préavis en cas de retour du salarié avant la fin du congé ;

4° Les délais de demande du salarié et de réponse de l’employeur sur le fractionnement du congé ou sa transformation en période d’activité à temps partiel.
