Article L3334-6 of the French Labour Code

The collective retirement savings plan may receive, at the initiative of the participants, payments of sums from profit-sharing, incentive schemes and other voluntary payments and contributions from companies as provided for in articles L. 3332-11 to L. 3332-13 and L. 3334-10.

In addition, if the plan rules so provide, companies may, even in the absence of an employee contribution:

1° Make an initial payment into the plan;

2° Make periodic payments into the plan, subject to uniform allocation to all employees. The frequency of these payments is specified in the plan rules.

The annual payment ceilings are set by decree.

These payments are subject to the same social and tax rules as the contributions made by the companies mentioned in the first paragraph of this article. They comply with article L. 3332-13.

Article L3334-6

Le plan d’épargne pour la retraite collectif peut recevoir, à l’initiative des participants, les versements des sommes issues de l’intéressement, de la participation ainsi que d’autres versements volontaires et des contributions des entreprises prévues aux articles L. 3332-11 à L. 3332-13 et L. 3334-10.

En outre, si le règlement du plan le prévoit, les entreprises peuvent, même en l’absence de contribution du salarié :


1° Effectuer un versement initial sur ce plan ;


2° Effectuer des versements périodiques sur ce plan, sous réserve d’une attribution uniforme à l’ensemble des salariés. La périodicité de ces versements est précisée dans le règlement du plan.


Les plafonds de versement annuel sont fixés par décret.


Ces versements sont soumis au même régime social et fiscal que les contributions des entreprises mentionnées au premier alinéa du présent article. Ils respectent l’article L. 3332-13.
