Without prejudice to acquired rights, and after informing the mayors of the municipalities concerned, the representative of the State in the département shall determine the distances within which on-trade premises may not be set up around the following establishments, which are listed exhaustively:
1° Health establishments, addiction care, support and prevention centres and harm reduction support centres for drug users;
2° Education, training, group accommodation or leisure establishments for young people;
3° Stadiums, swimming pools, public or private sports grounds.
These distances are calculated according to the straight line on the ground connecting the nearest entrances to the protected establishment and the public house. In this calculation, the difference in height above and below ground level must be taken into account, depending on whether the establishment is located in a high-rise building or in an underground structure.
The interior of the buildings and establishments in question is included in the protection zones determined in this way.
The existence of regularly established on-trade public houses may not be called into question on the grounds of this article.
In municipalities where there is no more than one on-trade public house, the representative of the State in the department may, after consulting the mayor, authorise the establishment of an on-trade public house in the areas covered by the provisions of this article where this is justified by the needs of tourism or local entertainment.
