Article L362-3 of the French Insurance Code

Any insurance undertaking whose registered office is located in the territory of a Member State of the European Union other than France and which provides cover in the territory of the French Republic under the freedom to provide services for civil liability risks arising from the use of land motor vehicles shall appoint a representative in France to handle claims in respect of such risks, excluding the carrier’s civil liability. The duties of the representative are laid down by decree in the Conseil d’Etat.

Toute entreprise d’assurance dont le siège social est situé sur le territoire d’un Etat membre de l’Union européenne autre que la France couvrant en libre prestation de services sur le territoire de la République française les risques de responsabilité civile résultant de l’emploi de véhicules terrestres à moteur désigne en France un représentant pour la gestion des sinistres à raison de ces risques à l’exclusion de la responsabilité civile du transporteur. Les missions du représentant sont fixées par décret en Conseil d’Etat.
