I. – For the application of articles L. 511-5, L. 512-4, L. 512-5, L. 512-6 et L. 513-1 of the Internal Security Code to the metropolis of Lyon:
1° The reference to the public establishment for inter-municipal cooperation is replaced by the reference to the metropolis of Lyon;
2° The reference to the president of the public establishment for inter-municipal cooperation is replaced by the reference to the president of the council of the metropolis;
3° The reference to the inter-municipal coordination agreement is replaced by the reference to the metropolitan coordination agreement.
II. – At the request of the mayors of several communes of the metropolis, the metropolis of Lyon may recruit, after deliberation by at least two thirds of the municipal councils of the communes concerned representing more than half of the total population of these communes or at least half of the municipal councils of the communes representing two thirds of the total population of these communes, one or more municipal police officers, with a view to making them available to all of these communes. Their appointment as probationary civil servants does not prevent them from being made available.
The municipal police officers thus recruited exercise, within the territory of each municipality to which they are assigned, the powers mentioned in article L. 511-1 of the Internal Security Code, without prejudice to the judicial police powers vested in them by the Code of Criminal Procedure and by special criminal laws. During the performance of their duties on the territory of a commune, they are placed under the authority of the mayor of this commune.
III. – Municipal police officers recruited by the Lyon metropolitan authority are appointed by the president of the council of the metropolitan authority, approved by the representative of the State in the department and by the public prosecutor, then sworn in under the conditions set out in article L. 511-2 of the same code.
Authorisation may be withdrawn or suspended by the State representative in the département or by the public prosecutor after consultation with the president of the metropolitan council. However, in an emergency, approval may be suspended by the public prosecutor without such consultation.
