Article L4043-1 of the French Public Health Code

The activities carried out jointly in accordance with the company’s articles of association, referred to in 2° and 3° of article L. 4041-2, are not subject to the prohibition on fee-splitting within the meaning of this code.

The members of an interprofessional outpatient care company are not deemed to engage in fee-splitting solely by virtue of their membership of the company and the joint practice of activities in accordance with the articles of association.

Les associés d’une société interprofessionnelle de soins ambulatoires ne sont pas réputés pratiquer le compérage du seul fait de leur appartenance à la société et de l’exercice en commun d’activités conformément aux statuts.
