I.-The possession, without a duly justified medical reason, of one or more substances or methods prohibited by the list mentioned in the last paragraph of article L. 425-1-1, for which Appendix 1 to the International Convention against Doping in Sport, adopted in Paris on 19 October 2005, only provides for the possibility of reduced sanctions in exceptional circumstances, is punishable by one year’s imprisonment and a fine of €3,750 in local currency.
II – Failure to comply with 1°, 2° and 4° of article L. 425-1-2 is punishable by five years’ imprisonment and a fine of €75,000 in local currency equivalent.
The penalties provided for in the first paragraph of II are increased to seven years’ imprisonment and a fine of €150,000 in local currency equivalent when the acts are committed as part of an organised gang, within the meaning ofArticle 132-71 of the Criminal Code, or when they are committed in respect of a minor or by a person with authority over one or more sportsmen and women.
