Subsection 2: Criminal provisions

Opposing or attempting to oppose the performance of the duties of the control officers authorised under article L. 425-2 is punishable by six months’ imprisonment and a fine of €7,500 in local currency equivalent. The following may exercise the rights granted to civil parties in respect of the offences mentioned in the anti-doping regulations issued by New Caledonia: a) The Territorial Olympic and Sports Committee for acts committed during competitions for which it is responsible; b) The sports leagues approved under the terms of the regulations governing sporting activities in New Caledonia, each insofar as it is concerned.

The prison sentences provided for in I, II and III of article 22 of deliberation no. 202 of the Congress of New Caledonia of 22 August 2006 relating to the protection of athletes’ health and the fight against doping in New Caledonia are hereby approved.

A person who has been banned temporarily or permanently from taking part in a competition or sporting event organised or approved by the leagues, committees or federations of New Caledonia, in application of the anti-doping regulations laid down by New Caledonia, may not take part in a competition or sporting event organised by other leagues, committees or federations of the Republic during the period of this ban.
