The pharmacist or company must own the pharmacy of which he is the proprietor.

A pharmacist or company may own or co-own only one dispensary.

Pharmacists are authorised to form a general partnership between themselves for the purpose of operating a pharmacy.

Pharmacists are also authorised to form a limited liability company, either individually or between themselves, with a view to operating a pharmacy, provided that this company owns only one pharmacy, regardless of the number of pharmacists associated, and that the pharmacy is managed by one or more of the associated pharmacists.

Managers and members are liable to third parties within the limits set out in articles L. 223-1 and L. 223-22 of the French Commercial Code.

There is no limit to the tort and quasi tort liability of the managing partners, who must be insured against all professional risks.

All associate pharmacists are bound by the obligations of article L. 4221-1. Consequently, as all their qualifications are registered for the operation of the pharmacy, they may not engage in any other pharmaceutical activity, with the exception of that of volunteer fire-fighter pharmacist.

Le pharmacien, ou la société, doit être propriétaire de l’officine dont il est titulaire.

Un pharmacien ou une société ne peut être propriétaire ou copropriétaire que d’une seule officine.

Les pharmaciens sont autorisés à constituer entre eux une société en nom collectif en vue de l’exploitation d’une officine.

Les pharmaciens sont également autorisés à constituer individuellement ou entre eux une société à responsabilité limitée en vue de l’exploitation d’une officine, à la condition que cette société ne soit propriétaire que d’une seule officine, quel que soit le nombre de pharmaciens associés, et que la gérance de l’officine soit assurée par un ou plusieurs des pharmaciens associés.

Les gérants et les associés sont responsables à l’égard des tiers dans les limites fixées aux articles L. 223-1 et L. 223-22 du code de commerce.

Aucune limite n’est apportée à la responsabilité délictuelle et quasi délictuelle des gérants, qui sont obligatoirement garantis contre tous les risques professionnels.

Tous les pharmaciens associés sont tenus aux obligations de l’article L. 4221-1. En conséquence, tous leurs diplômes étant enregistrés pour l’exploitation de l’officine, ils ne peuvent exercer aucune autre activité pharmaceutique, à l’exception de celle de pharmacien de sapeur-pompier volontaire.
