Article L521-6 of the French Insurance Code

The information provided by the distributor to the subscriber pursuant to Articles L. 521-2 to L. 521-4 and L. 522-1 to L. 522-6 shall be provided on paper.

This information may also be provided on a durable medium other than paper, provided that, notwithstanding the provisions of Article L. 111-10, this medium is appropriate for commercial transactions between the distributor and the subscriber and that the subscriber has chosen this method of communication after being offered both methods by the distributor.

Notwithstanding the provisions of article L. 111-10, be provided via a website if it is addressed personally to the subscriber or member or if the following conditions are met:

1° The use of this means is appropriate to the commercial transactions between the distributor and the subscriber;

2° The subscriber has agreed to the use of this means;

3° The distributor has notified the subscriber electronically of the address of the website and the place on the site where the information can be found;

4° Access to the aforementioned information on the website is guaranteed for a reasonable period of time to ensure that it can be consulted by the subscriber.

Article L521-6

La communication des informations fournies par le distributeur au souscripteur ou à l’adhérent en application des articles L. 521-2 à L. 521-4 et L. 522-1 à L. 522-6 est effectuée sur support papier.

Cette communication peut également être effectuée sur un support durable autre que le papier, sous réserve et par dérogation aux dispositions de l’article L. 111-10, que ce support soit approprié aux opérations commerciales entre le distributeur et le souscripteur et adhérent et que ce dernier ait choisi ce mode de communication après s’être vu proposé par le distributeur les deux modalités.

Les informations mentionnées au premier alinéa peuvent également, par dérogation aux dispositions de l’article L. 111-10, être fournies au moyen d’un site internet si elles sont adressées personnellement au souscripteur ou adhérent ou si les conditions suivantes sont remplies :

1° L’utilisation de ce moyen est appropriée aux opérations commerciales entre le distributeur et le souscripteur et adhérent ;

2° Le souscripteur ou l’adhérent a donné son accord à l’utilisation de ce moyen ;

3° Le distributeur a notifié par voie électronique au souscripteur ou adhérent l’adresse du site internet ainsi que l’endroit sur ce site où ces informations peuvent être trouvées ;

4° L’accès des informations susmentionnées sur le site internet est garanti pendant une durée raisonnable garantissant leur consultation possible par le souscripteur ou adhérent.
