Article L5215-31 of the French General Code of Local Authorities

Within the perimeter of the conurbation in which the urban community exercises its powers, roads may be redistributed between the State, the département and the urban community.

The corresponding classifications and declassifications take place after a public enquiry carried out in accordance with the code of relations between the public and the administration and consultation with the community council and the departmental council.

They are pronounced either by joint order of the Minister of the Interior and the Minister responsible for Equipment, or by order of the Minister of the Interior, depending on whether or not national roads are involved.

A l’intérieur du périmètre de l’agglomération dans laquelle la communauté urbaine exerce ses compétences, il peut être procédé à une redistribution des voies entre l’Etat, le département et la communauté urbaine.

Les classements et déclassements correspondants interviennent après enquête publique réalisée conformément au code des relations entre le public et l’administration et consultation du conseil de communauté et du conseil départemental.

Ils sont prononcés soit par arrêté conjoint du ministre de l’intérieur et du ministre chargé de l’équipement, soit par arrêté du ministre de l’intérieur, suivant qu’il s’agit ou non de routes nationales.
