Article L6112-4 of the French Public Health Code

I.- When the Director General of the Regional Health Agency becomes aware of a breach of the obligations laid down in this chapter by an establishment providing a public hospital service, he will notify the legal representative of the establishment.

The establishment will communicate its observations and the corrective measures taken or planned as part of an adversarial procedure, the procedures for which are laid down by the Conseil d’Etat decree referred to in Article L. 6112-7.

II – At the end of the adversarial procedure, the Director General of the Regional Health Agency and, in the case of army hospitals, the Ministers for Defence and Health may impose:

1° A financial penalty, the amount of which may not exceed 5% of the income received by the health care institution from compulsory health insurance schemes during the previous year;

2° Withdrawal of the authorisation granted to the institution in application of article L. 6112-3. The establishment concerned may not submit a new application for authorisation until one year has elapsed from notification of the withdrawal.

These penalties are proportionate to the seriousness of the breaches observed.

Article L6112-4

I.-Lorsqu’il constate un manquement aux obligations prévues au présent chapitre par un établissement assurant le service public hospitalier, le directeur général de l’agence régionale de santé le notifie au représentant légal de l’établissement.

L’établissement communique ses observations et les mesures correctrices apportées ou envisagées dans le cadre d’une procédure contradictoire, dont les modalités sont fixées par le décret en Conseil d’Etat mentionné à l’article L. 6112-7.

II.-A l’issue de la procédure contradictoire, le directeur général de l’agence régionale de santé et, pour les hôpitaux des armées, les ministres chargés de la défense et de la santé peuvent prononcer :

1° Une pénalité financière, dont le montant ne peut excéder 5 % des produits reçus des régimes obligatoires d’assurance maladie par l’établissement de santé au cours de l’année précédente ;

2° Le retrait de l’habilitation accordée à l’établissement en application de l’article L. 6112-3. L’établissement concerné ne peut alors présenter de nouvelle demande d’habilitation avant l’expiration d’un délai d’un an à compter de la notification du retrait.

Ces sanctions sont proportionnées à la gravité des manquements constatés.
