Article R112-4 of the French Insurance Code

For the purposes of article L. 112-2-1, the insurer must provide the policyholder with the following information:

1° The procedures for taking out the contract and paying the premium or contribution.

This information, the commercial nature of which must be unequivocally apparent, is provided in a clear and comprehensible manner by any means appropriate to the distance marketing technique used.

2° In the case of voice telephony, the name of the insurer and the commercial nature of the call are indicated unequivocally at the beginning of any conversation with the policyholder. The person in contact with the policyholder must also state their identity and their relationship with the insurer.

Subject to the formal agreement of the policyholder, only the information mentioned in 2°, 3° and 5° of III of article L. 112-1-12-1 must be communicated to the policyholder. The policyholder is informed that the information mentioned in 1°, 4°, 6° and 7° may be provided on request.

In addition, the insurer is required to provide all the information mentioned in III of article L. 112-2-1 when it fulfils its obligations under article L. 222-6 of the French Consumer Code.

Pour l’application de l’article L. 112-2-1, l’assureur communique au souscripteur les informations suivantes :

1° Les modalités de conclusion du contrat et de paiement de la prime ou cotisation.

Ces informations, dont le caractère commercial doit apparaître sans équivoque, sont fournies de manière claire et compréhensible par tout moyen adapté à la technique de commercialisation à distance utilisée.

2° En cas de communication par téléphonie vocale, le nom de l’assureur ainsi que le caractère commercial de l’appel sont indiqués sans équivoque au début de toute conversation avec le souscripteur. La personne en contact avec le souscripteur doit en outre préciser son identité et son lien avec l’assureur.

Sous réserve de l’accord formel du souscripteur, seules les informations mentionnées aux 2°, 3° et 5° du III de l’article L. 112-1-12-1 doivent lui être communiquées. Il est porté à la connaissance du souscripteur que les informations mentionnées aux 1°, 4°, 6° et 7° peuvent lui être fournies sur demande.

En outre, l’assureur est tenu de fournir l’ensemble des informations mentionnées au III de l’article L. 112-2-1 lorsqu’il remplit ses obligations en vertu de l’article L. 222-6 du code de la consommation.
