Article R144-20 of the French Insurance Code

I. – For each plan, the statutory auditor(s) of the insurance undertaking certify that the annual accounts of the plan are true and fair.

II – The statutory auditor(s) will be invited to attend the meeting of the plan’s supervisory committee at which the latter will issue an opinion on the plan’s annual accounts.

On this occasion, the Statutory Auditor(s) shall inform the Supervisory Committee of:

1° The checks and verifications they have carried out and the various tests performed;

2° The items in the balance sheet and other accounting documents to which they feel changes should be made, making any useful observations on the valuation methods used to draw up these documents;

3° Any irregularities and inaccuracies they have discovered;

4° The conclusions reached on the annual accounts as a result of the above observations and corrections.

I. ― Pour chaque plan, le ou les commissaires aux comptes de l’entreprise d’assurance certifient que les comptes annuels du plan sont réguliers et sincères.


II. ― Le ou les commissaires aux comptes sont convoqués à la réunion du comité de surveillance du plan au cours de laquelle ce dernier délivre un avis sur les comptes annuels du plan.


A cette occasion, le ou les commissaires aux comptes portent à la connaissance du comité de surveillance :


1° Les contrôles et vérifications auxquels ils ont procédé et les différents sondages effectués ;


2° Les postes du bilan et des autres documents comptables auxquels des modifications leur paraissent devoir être apportées, en faisant toutes observations utiles sur les méthodes d’évaluation utilisées pour l’établissement de ces documents ;


3° Les irrégularités et les inexactitudes qu’ils auraient découvertes ;


4° Les conclusions auxquelles conduisent les observations et rectifications ci-dessus sur les comptes annuels.
