Article R175-1 of the French Insurance Code

The limitation period for actions arising from an insurance contract runs from:

1° In the case of an action for payment of the premium, the date on which the premium became due;

2° In the case of a claim by the insured or the beneficiary of the insurance on whose behalf the contract was taken out pursuant to article L. 171-4, from the date of the event giving rise to the claim or from the date on which the insured or the beneficiary became aware of the event, if he/she can prove that he/she was unaware of it until that date;

3° Where the insured’s action is based on recourse by a third party, from the date of the legal action against the insured;

4° For an action for repayment of any sum paid under the insurance contract, from the date of the undue payment.

Le délai de prescription des actions nées du contrat d’assurance court :


1° En ce qui concerne l’action en paiement de la prime, de la date d’exigibilité ;


2° En ce qui concerne la réclamation de l’assuré ou du bénéficiaire de l’assurance pour le compte duquel le contrat a été souscrit en application de l’article L. 171-4, de la date de l’événement qui donne lieu à celle-ci ou du jour où l’assuré ou le bénéficiaire en a eu connaissance, s’il prouve qu’il l’a ignoré jusque-là ;


3° Lorsque l’action de l’assuré a pour cause le recours d’un tiers, du jour de l’action en justice à l’encontre de l’assuré ;


4° Pour l’action en répétition de toute somme payée en vertu du contrat d’assurance, de la date du paiement indu.
