Article R211-26 of the French Tourism Code

The financial guarantee provided for in a of II of article L. 211-18 is the result of a written guarantee undertaking given :

1° Either by a collective guarantee body with legal personality, by means of a guarantee fund set up for this purpose;

2° Or by a credit institution, finance company or insurance company authorised to provide a financial guarantee;

3° Or by a group of non-profit-making associations or organisations that have been specifically authorised by an order of the Minister responsible for tourism and have a sufficient solidarity fund.

The financial guarantee is allocated to the reimbursement of funds received by the travel and holiday operator in respect of commitments it has entered into with the traveller for services in progress or to be provided and makes it possible to ensure, in particular in the event of suspension of payments leading to a bankruptcy filing, the repatriation of travellers and the payment of additional accommodation costs that would result directly from the organisation of repatriation.

The financial guarantee undertaking must comply with all the regulatory provisions of this section.

A joint order of the ministers responsible for the economy and tourism sets, in proportion to the average premiums or contributions collected and the cost of claims, the prudential rules applicable to the bodies mentioned in 1° and 3° of this article, which guarantee a level of solvency equivalent to that of entities subject to supervision by a prudential supervisory authority and engaged in the activity to which the guarantee commitment mentioned in the first paragraph relates.

Article R211-26

La garantie financière prévue au a du II de l’article L. 211-18 résulte d’un engagement écrit de cautionnement pris :

1° Soit par un organisme de garantie collective doté de la personnalité juridique, au moyen d’un fonds de garantie constitué à cet effet ;

2° Soit par un établissement de crédit, une société de financement ou une entreprise d’assurances habilités à donner une garantie financière ;

3° Soit par un groupement d’associations ou d’organismes sans caractère lucratif ayant fait l’objet d’une autorisation particulière par un arrêté du ministre chargé du tourisme et disposant d’un fonds de solidarité suffisant.

La garantie financière est affectée au remboursement des fonds reçus par l’opérateur de voyages et de séjours au titre des engagements qu’il a contractés à l’égard du voyageur pour des prestations en cours ou à servir et permet d’assurer, notamment en cas de cessation de paiements ayant entraîné un dépôt de bilan, le rapatriement des voyageurs et la prise en charge des frais de séjour supplémentaires qui résulteraient directement de l’organisation du rapatriement.

L’engagement de garantie financière doit répondre à toutes les dispositions réglementaires de la présente section.

Un arrêté conjoint des ministres chargés de l’économie et du tourisme fixe, en proportion de la moyenne des primes ou cotisations encaissées et de la charge des sinistres, les règles prudentielles applicables aux organismes mentionnés au 1° et au 3° du présent article qui permettent de garantir un niveau de solvabilité équivalent à celui des entités soumises au contrôle d’une autorité de contrôle prudentiel pratiquant l’activité à laquelle se rattache l’engagement de cautionnement mentionné au premier alinéa.
