Article R211-42 of the French Tourism Code

When the travel operator intends to directly conclude a timeshare contract governed by articles L. 121-60 to L. 121-76 of the Consumer Code, or to assist in the conclusion of such a contract, he must submit the following documents to the registration commission mentioned in article L. 141-2:

1° Proof of a financial guarantee sufficient to cover these activities separately, earmarked for the repayment of funds, bills or securities held on behalf of third parties and sums for which the travel operator remains liable at any time on payments or remittances made to him in the course of these activities;

2° An insurance certificate guaranteeing professional civil liability relating to these activities.

The Registration Commission acknowledges receipt of these documents.

Lorsque l’opérateur de voyages envisage de conclure directement un contrat de jouissance d’immeuble à temps partagé régi par les articles L. 121-60 à L. 121-76 du code de la consommation, ou de prêter son concours à la conclusion d’un tel contrat, il adresse à la commission d’immatriculation mentionnée à l’article L. 141-2 les pièces suivantes :

1° L’attestation d’une garantie financière suffisante pour couvrir séparément ces activités, affectée au remboursement des fonds, effets ou valeurs détenus pour autrui et des sommes dont l’opérateur de voyages demeure redevable à tout moment sur les versements ou remises qui lui ont été faits dans l’exercice de ces activités ;

2° L’attestation d’assurance garantissant la responsabilité civile professionnelle relative à ces activités.

La commission d’immatriculation accuse réception de ces pièces.
