Article R2123-20 of the French General Code of Local Authorities

The benefit of training leave is by right to carry out a training course or attend a training session meeting the criteria set out in article R. 2123-12.

It may, however, be refused if the requirements of the operation of the service preclude it.

Decisions rejecting requests for training leave must be communicated with their reasons to the joint administrative committee during the meeting following this decision.

If the official concerned renews his request at the end of a period of four months after being notified of an initial refusal, a new refusal may not be made.

Le bénéfice du congé de formation est de droit pour effectuer un stage ou suivre une session de formation répondant aux critères fixés à l’article R. 2123-12.

Il peut, cependant, être refusé si les nécessités du fonctionnement du service s’y opposent.

Les décisions qui rejettent des demandes de congés de formation doivent être communiquées avec leur motif à la commission administrative paritaire au cours de la réunion qui suit cette décision.

Si le fonctionnaire concerné renouvelle sa demande à l’expiration d’un délai de quatre mois après la notification d’un premier refus, un nouveau refus ne peut lui être opposé.
