Article R2212-16 of the French Public Health Code

Only doctors, midwives, family planning or education centres and health centres that have signed the agreement referred to in article R. 2212-9 may obtain the medicines required to carry out a voluntary interruption of pregnancy by medication or by an instrumental method.

In order to obtain the medicines required to carry out this voluntary interruption of pregnancy, an order for professional use is placed with a dispensing pharmacy. This order, drawn up in accordance with the conditions laid down in article R. 5132-4, also indicates the name of the public or private health establishment with which the centre concerned, the doctor or the midwife has concluded the agreement referred to in article R. 2212-9 and the date of this agreement.

By way of derogation from the provisions of the first paragraph, the medicines required to carry out a voluntary interruption of pregnancy by medication may be dispensed to the woman receiving them by a dispensing pharmacy, when the prescription is made during a teleconsultation, under the conditions provided for in the second paragraph of article R. 2212-14-1.

Seuls les médecins, les sages-femmes, les centres de planification ou d’éducation familiale et les centres de santé ayant conclu la convention mentionnée à l’article R. 2212-9 peuvent s’approvisionner en médicaments nécessaires à la réalisation d’une interruption volontaire de grossesse par voie médicamenteuse ou par méthode instrumentale.

Pour s’approvisionner en médicaments nécessaires à la réalisation de cette interruption volontaire de grossesse, il est passé commande à usage professionnel auprès d’une pharmacie d’officine. Cette commande, rédigée dans les conditions prévues à l’article R. 5132-4, indique en outre le nom de l’établissement de santé, public ou privé, avec lequel le centre concerné, le médecin ou la sage-femme a conclu la convention mentionnée à l’article R. 2212-9 et la date de cette convention.

Par dérogation aux dispositions du premier alinéa, les médicaments nécessaires à la réalisation d’une interruption volontaire de grossesse par voie médicamenteuse peuvent être délivrés à la femme en bénéficiant par une pharmacie d’officine, lorsque la prescription est effectuée lors d’une téléconsultation, dans les conditions prévues au deuxième alinéa de l’article R. 2212-14-1.
