Article R2212-2 of the French Public Health Code

To qualify for approval for the application of article L. 2212-4, the organisations mentioned in 4° of article R. 2212-1 must satisfy the following conditions:

1° They must be managed by a legal person governed by public law or by a legal person governed by private law with a non-profit-making aim and a social purpose ;

2° Have premises suitable for the type of maintenance provided for in article L. 2212-4 ;

3° Have staff available for consultations who have the necessary skills and experience and who have not been convicted of acts contrary to honour, probity or morality, or of an offence under articles 226-13 and 226-14 of the Criminal Code, Title II of this Book and Chapter IV of Title III of Book IV of Part V of this Code;

4° Undertake to ensure that consultations take place at least once a week.

Article R2212-2

Pour bénéficier d’un agrément pour l’application de l’article L. 2212-4, les organismes mentionnés au 4° de l’article R. 2212-1 doivent satisfaire aux conditions suivantes :

1° Etre gérés par une personne morale de droit public ou par une personne morale de droit privé à but non lucratif et à vocation sociale ;

2° Disposer de locaux appropriés à la nature de l’entretien prévu à l’article L. 2212-4 ;

3° Disposer d’un personnel assurant les consultations présentant les aptitudes et l’expérience nécessaires et n’ayant pas été condamné pour des faits contraires à l’honneur, à la probité et aux bonnes moeurs, ou pour une infraction prévue aux articles 226-13 et 226-14 du code pénal, au titre II du présent livre et au chapitre IV du titre III du livre IV de la partie V du présent code ;

4° S’engager à assurer une périodicité au moins hebdomadaire des consultations.
