Article R2213-1-2 of the French General Code of Local Authorities

I. – Subject to the exceptions provided for in article R. 2213-1-4, the doctor, student or practitioner who recorded the death shall, as soon as possible, draw up a certificate on an electronic medium in compliance with the provisions of article L. 1110-4-1 of the Public Health Code and transmit the sections of this certificate without delay under the conditions set out in II, III and IV.

II. – The administrative section of the death certificate is drawn up electronically. It is sent by secure electronic means to the town hall of the place of death, to the agency, company or association authorised under the conditions defined in article L. 2223-23, responsible for providing the funeral and, if the body is transported, to the town hall of the place where the body is deposited and to the funeral home manager.

III. – The data on the medical section of the death certificate are transmitted by the doctor, student or practitioner, after encryption, to the Institut national de la santé et de la recherche médicale or to the body appointed by this institute to manage the system for collecting and transmitting the certificates entered, under the conditions defined by this institute and designed to guarantee the security, confidentiality and integrity of these data.

IV. – The death certificate may only be transmitted if the administrative section and the medical section have been completed in full.

During the ninety-six hours following transmission of the death certificate, the doctor, student or practitioner may modify the information on the medical section. Any change during this period will result in a new transmission to the receiving organisation.

V. – On receipt of the administrative section, the civil registrar at the town hall sends a bulletin by post or electronically to the Institut national de la statistique et des études économiques under the conditions defined by the amended decree no. 82-103 of 22 January 1982 relating to the national register for the identification of natural persons.

I. – Sous réserve des exceptions prévues à l’article R. 2213-1-4, le médecin, l’étudiant ou le praticien ayant constaté le décès établit, dans les meilleurs délais, sur support électronique un certificat dans le respect des dispositions de l’article L. 1110-4-1 du code de la santé publique et transmet sans délais les volets de ce certificat dans les conditions fixées aux II, III et IV.

II. – Le volet administratif du certificat de décès est établi sur support électronique. Il est transmis par voie dématérialisée sécurisée à la mairie du lieu de décès, à la régie, à l’entreprise ou à l’association, habilitée dans les conditions définies à l’article L. 2223-23, chargée de pourvoir aux funérailles et, en cas de transport du corps, à la mairie du lieu de dépôt du corps et au gestionnaire de la chambre funéraire.

III. – Les données du volet médical du certificat de décès sont transmises par le médecin, l’étudiant ou le praticien, après chiffrement, à l’Institut national de la santé et de la recherche médicale ou à l’organisme chargé par cet institut de gérer le système de collecte et de transmission des certificats saisis, dans les conditions définies par cet institut et visant à garantir la sécurité, la confidentialité et l’intégrité de ces données.

IV. – La transmission du certificat de décès ne peut avoir lieu que si le volet administratif et le volet médical sont intégralement établis.

Pendant les quatre-vingt-seize heures suivant la transmission du certificat de décès, le médecin, l’étudiant ou le praticien peut modifier les informations du volet médical. Toute modification pendant ce délai donne lieu à une nouvelle transmission à l’organisme destinataire.

V. – Lors de la réception du volet administratif, l’officier d’état civil de la mairie envoie par voie postale ou électronique à l’Institut national de la statistique et des études économiques un bulletin dans les conditions définies par le décret n° 82-103 du 22 janvier 1982 modifié relatif au répertoire national d’identification des personnes physiques.
