Article R2213-23 of the French General Code of Local Authorities

The entry into France of the body of a person who has died in the overseas collectivities, in New Caledonia or abroad and its transfer to the place of burial or cremation, as well as transit through French territory, are carried out on the basis of an authorisation issued by the French consular representative or by the Government delegate.

However, when the death has occurred in a foreign country adhering to an international arrangement for the transport of corpses, the entry of the corpse into France is carried out on the basis of a special laissez-passer issued by the competent authority for the place of exhumation when the remains have already been buried.

When death occurs on board a ship during a voyage, the body is brought into France on the basis of the maritime declaration of health drawn up by the ship’s captain and countersigned, where applicable, by the ship’s doctor. In this case, the body is placed in a coffin meeting the conditions set out in article R. 2213-27.

L’entrée en France du corps d’une personne décédée dans les collectivités d’outre-mer, en Nouvelle-Calédonie ou à l’étranger et son transfert au lieu de sépulture ou de crémation, ainsi que le passage en transit sur le territoire français, sont effectués au vu d’une autorisation délivrée par le représentant consulaire français ou par le délégué du Gouvernement.

Cependant, quand le décès s’est produit dans un pays étranger adhérent à un arrangement international pour le transport des corps, l’entrée du corps en France s’effectue au vu d’un laissez-passer spécial délivré par l’autorité compétente pour le lieu d’exhumation lorsqu’il s’agit de restes déjà inhumés.

Lorsque le décès s’est produit à bord d’un navire au cours d’un voyage, l’entrée du corps en France s’effectue au vu de la déclaration maritime de santé établie par le capitaine du navire et contresignée, le cas échéant, par le médecin du bord. Dans ce cas, le corps est placé dans un cercueil répondant aux conditions prévues à l’article R. 2213-27.
