Article R2221-22 of the French General Code of Local Authorities

The legal representative of an régie is either the director in the case of an régie responsible for the operation of a public service of an industrial and commercial nature, or the chairman of the board of directors in the case of an régie responsible for the operation of a public service of an administrative nature.

The legal representative, after authorisation from the board of directors, brings legal actions in the name of the régie and defends the régie in actions brought against it. Settlements are concluded under the same conditions.

The legal representative may, without the prior authorisation of the Board of Directors, take any steps to preserve the rights of the régie.

Le représentant légal d’une régie est, soit le directeur lorsqu’il s’agit d’une régie chargée de l’exploitation d’un service public à caractère industriel et commercial, soit le président du conseil d’administration lorsqu’il s’agit d’une régie chargée de l’exploitation d’un service public à caractère administratif.

Le représentant légal après autorisation du conseil d’administration intente au nom de la régie les actions en justice et défend la régie dans les actions intentées contre elle. Les transactions sont conclues dans les mêmes conditions.

Le représentant légal peut, sans autorisation préalable du conseil d’administration, faire tous actes conservatoires des droits de la régie.
