Article R2221-28 of the French General Code of Local Authorities

The Director, under the authority and control of the Chairman of the Board of Directors, is responsible for the operation of the régie. To this end:

1° He shall take the measures necessary to implement the decisions of the Board of Directors;

2° He shall exercise the management of all departments, subject to the provisions below concerning the accounting officer;

3° He shall recruit and dismiss the necessary staff within the limits of the budgetary entries ;

4° He may have certain agents appointed by him and approved by the Prefect sworn in;

5° He is the authorising officer of the régie and, in this capacity, prescribes the execution of revenue and expenditure;

6° He shall, in execution of the decisions of the Board of Directors, pass all deeds, contracts and markets.

In addition, the Director takes the decisions for which he has been delegated under the provisions of c of article L. 2221-5-1.

Article R2221-28

Le directeur assure, sous l’autorité et le contrôle du président du conseil d’administration, le fonctionnement de la régie. A cet effet :

1° Il prend les mesures nécessaires à l’exécution des décisions du conseil d’administration ;

2° Il exerce la direction de l’ensemble des services, sous réserve des dispositions ci-après concernant le comptable ;

3° Il recrute et licencie le personnel nécessaire dans la limite des inscriptions budgétaires ;

4° Il peut faire assermenter certains agents nommés par lui et agréés par le préfet ;

5° Il est l’ordonnateur de la régie et, à ce titre, prescrit l’exécution des recettes et des dépenses ;

6° Il passe, en exécution des décisions du conseil d’administration, tous actes, contrats et marchés.

En outre, le directeur prend les décisions pour lesquelles il a reçu délégation en vertu des dispositions du c de l’article L. 2221-5-1.
