The creation or extension of a burial chamber is authorised by the prefect.
The application file for the creation or extension of a burial chamber must include:
– an explanatory note;
– a site plan;
– a draft public notice detailing the terms of the planned project. The notice is then published, at the applicant’s expense, in two regional or local newspapers.
The prefect consults the town council, which gives its opinion within two months, and obtains the opinion of the departmental council for the environment and health and technological risks.
The decision is made within four months of the application being submitted. In the absence of notification of the decision on expiry of this period, authorisation is deemed to have been granted.
Authorisation may only be refused in the event of a breach of public order or a danger to public health.
In the same cases, the prefect may, after formal notice, order the temporary or permanent closure of the funeral home. The mayor of the commune concerned is informed.
