Article R2223-74 of the French General Code of Local Authorities

The creation or extension of a burial chamber is authorised by the prefect.

The application file for the creation or extension of a burial chamber must include:

– an explanatory note;

– a site plan;

– a draft public notice detailing the terms of the planned project. The notice is then published, at the applicant’s expense, in two regional or local newspapers.

The prefect consults the town council, which gives its opinion within two months, and obtains the opinion of the departmental council for the environment and health and technological risks.

The decision is made within four months of the application being submitted. In the absence of notification of the decision on expiry of this period, authorisation is deemed to have been granted.

Authorisation may only be refused in the event of a breach of public order or a danger to public health.

In the same cases, the prefect may, after formal notice, order the temporary or permanent closure of the funeral home. The mayor of the commune concerned is informed.

La création ou l’extension d’une chambre funéraire est autorisée par le préfet.

Le dossier de demande de création ou d’extension d’une chambre funéraire comprend obligatoirement :

– une notice explicative ;

– un plan de situation ;

– un projet d’avis au public détaillant les modalités du projet envisagé. L’avis est ensuite publié, à la charge du demandeur, dans deux journaux régionaux ou locaux.

Le préfet consulte le conseil municipal, qui se prononce dans un délai de deux mois, et recueille l’avis du conseil départemental de l’environnement et des risques sanitaires et technologiques.

La décision intervient dans le délai de quatre mois suivant le dépôt de la demande. En l’absence de notification de la décision à l’expiration de ce délai, l’autorisation est considérée comme accordée.

L’autorisation ne peut être refusée qu’en cas d’atteinte à l’ordre public ou de danger pour la salubrité publique.

Dans les mêmes cas, le préfet peut, après mise en demeure, ordonner la fermeture provisoire ou définitive de la chambre funéraire. Le maire de la commune concernée est informé.
