When the centres supply free of charge to the persons mentioned in article L. 2311-5 medicines for the treatment of the diseases mentioned in article R. 2311-14, they must enlist the help of a pharmacist registered in section D or E of the national order of pharmacists.
If the centre is part of a health establishment, this pharmacist may be one of the pharmacists from the establishment’s in-house pharmacy, which supplies the centre under the conditions set out in article R. 5104-10.
If there is no pharmacist, the director or another doctor of the centre, designated by name, may be authorised by the Director General of the Regional Health Agency to manage and supply these medicines directly to the persons mentioned in the first paragraph.
Silence on the part of the Director General of the Regional Health Agency will be deemed to constitute tacit authorisation on expiry of a period of two months from the date of receipt of the application.
