I.-The amount of cover provided by the insurance contract(s) referred to in article L. 243-9 must cover the persons referred to in articles L. 241-1, L. 241-2, L. 242-1 and L. 242-2 up to a minimum amount per structure. This amount may not be less than the total construction cost declared by the project owner, or 150 million euros if this cost exceeds 150 million euros.
Where a collective insurance contract as referred to in article R. 243-1 is used, the total cover provided by the collective contract and by the contracts covering each of the persons insured under the collective contract must cover the cost of repairing the damage for which one or more of these persons has ten-year liability, up to the total construction cost declared by the client, or 150 million euros if this cost exceeds 150 million euros.
II – The amount of the guarantee ceiling mentioned in I may be modified by joint order of the Minister for the Economy and the Minister for Construction, taking into account changes in the cost of construction and the economic capacity of the insurance and reinsurance markets.
