Article R325-4 of the French Insurance Code

Before withdrawing the authorisation provided for in Article L. 325-1 or in this Code or in Articles 6 or 7 of Article L. 612-39 of the Monetary and Financial Code, in the case of an undertaking authorised in accordance with the provisions of Article L. 321-7, the Autorité de contrôle prudentiel et de résolution shall consult the supervisory authority of the State in which the registered office of the undertaking is located.

However, the Autorité de contrôle prudentiel et de résolution may suspend the activity of the undertaking in the territory of the French Republic before this consultation has been completed. In this case, it will immediately inform the foreign supervisory authority concerned.

Article R325-4

Avant de procéder au retrait d’agrément prévu à l’article L. 325-1 ou du présent code ou aux 6 ou 7 de l’article L. 612-39 du code monétaire et financier, dans le cas d’une entreprise agréée conformément aux dispositions de l’article L. 321-7, l’Autorité de contrôle prudentiel et de résolution consulte l’autorité de contrôle de l’Etat où est situé le siège social de cette entreprise.

Toutefois, l’Autorité de contrôle prudentiel et de résolution peut suspendre l’activité de l’entreprise sur le territoire de la République française avant l’issue de cette consultation. Dans ce cas, elle en informe immédiatement l’autorité de contrôle étrangère intéressée.
