Article R331-22-1 of the French Sports Code

The organiser of a sporting event on an approved permanent circuit must obtain the opinion of the relevant delegated federation before submitting his declaration file to the administrative authority.

The federation gives its opinion, which must be substantiated with regard to the technical and safety rules of the discipline, within one month of receiving the request for an opinion.

This opinion is communicated by any means to the organiser and, in the event of an unfavourable opinion, to the administrative authority.

If the opinion is not issued within one month, it is deemed to be favourable.

The obligation to obtain this opinion is waived:

1° When the event is organised by members of the delegating federation responsible for issuing the opinion and this event is included in the federation’s calendar mentioned in 1° ofarticle R. 131-26;

2° When the event is organised by an approved federation or one of its members and there is, in the discipline which is the subject of the event, an annual agreement concluded between this federation and the delegating federation concerned and relating to the implementation by the approved federation of the technical and safety rules laid down by the delegating federation.

L’organisateur d’une manifestation sportive sur un circuit permanent homologué doit recueillir l’avis de la fédération délégataire concernée, préalablement au dépôt de son dossier de déclaration auprès de l’autorité administrative.

La fédération rend son avis, qui doit être motivé au regard des règles techniques et de sécurité de la discipline, dans un délai d’un mois à compter de la réception de la demande d’avis.

Cet avis est communiqué par tout moyen à l’organisateur et, en cas d’avis défavorable, à l’autorité administrative.

Faute d’avoir été émis dans le délai d’un mois, l’avis est réputé favorable.

Il est dérogé à l’obligation de recueillir cet avis :

1° Lorsque la manifestation est organisée par des membres de la fédération délégataire chargée de rendre l’avis et que cette manifestation est inscrite au calendrier de la fédération mentionné au 1° de l’article R. 131-26 ;

2° Lorsque la manifestation est organisée par une fédération agréée ou un de ses membres et qu’il existe, dans la discipline faisant l’objet de la manifestation, une convention annuelle conclue entre cette fédération et la fédération délégataire concernée et portant sur la mise en œuvre par la fédération agréée des règles techniques et de sécurité édictées par la fédération délégataire.
