Article R421-34 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the issue of the multi-annual residence permit bearing the “talent passport” mention provided for in article L. 421-16, the competent diplomatic or consular authority or prefect verifies the compatibility of the activity in question with public safety, health and peace and quiet and, where applicable, the absence of any conviction or decision carrying with it a ban in France on carrying out a commercial activity.

Pour la délivrance de la carte de séjour pluriannuelle portant la mention ” passeport talent ” prévue à l’article L. 421-16, l’autorité diplomatique ou consulaire ou le préfet compétent vérifie la compatibilité de l’activité en cause avec la sécurité, la salubrité et la tranquillité publiques ainsi que, le cas échéant, l’absence de condamnation ou de décision emportant en France l’interdiction d’exercer une activité commerciale.
