Article R421-54 of the French Insurance Code

The liquidator referred to in article R. 421-53 shall, with the agreement of the guarantee fund, manage the files relating to compensation for losses covered by insurance, the subscription of which is made compulsory by articles L. 211-1 or L. 242-1, and which are insured with the company in liquidation. It must, at the request of the fund, provide it with any explanations or documents relating to these cases.

All costs and expenses incurred in connection with this management shall be borne by the liquidation.

The liquidator may only acquiesce in a court decision, enter into a settlement or raise an objection with an injured third party after obtaining the agreement of the guarantee fund.

Le liquidateur mentionné à l’article R. 421-53 gère, avec l’accord du fonds de garantie, les dossiers relatifs à l’indemnisation des dommages couverts par une assurance, dont la souscription est rendue obligatoire par les articles L. 211-1 ou L. 242-1, et qui sont assurés auprès de l’entreprise en liquidation. Il doit, sur demande du fonds, lui fournir toutes explications ou lui communiquer tous documents relatifs à ces dossiers.

Les frais et dépenses de toute nature afférents à cette gestion sont à la charge de la liquidation.

Le liquidateur ne peut acquiescer à une décision de justice, conclure une transaction ou opposer une exception au tiers lésé qu’après avoir obtenu l’accord du fonds de garantie.
