Article R424-11 of the French Insurance Code

Farmers and owners of agricultural and forestry land submit claims for compensation for damage caused by the agricultural spreading of sewage sludge to the Prefect, who acknowledges receipt. The composition of the compensation claim file is set by order of the Minister for the Environment.

The persons mentioned in the first paragraph have the option of grouping their application for one or more parcels concerning them.

If the Prefect considers that the claim is incomplete, he will invite the claimants to complete their file. If the application is complete, the Prefect will acknowledge receipt and forward it to the Minister for the Environment, with a view to referral to the National Expertise Commission provided for in article R. 424-12. The Prefect will accompany this transmission with observations, including an assessment of the information and declarations contained in the file.

On acknowledgement of receipt, the Prefect informs the applicant that his application has been forwarded to the Minister, of the content of his comments and of the procedure leading to the decision provided for in article R. 424-14.

Les exploitants agricoles et les propriétaires de terres agricoles et forestières transmettent les demandes d’indemnisation de dommages causés par l’épandage agricole des boues d’épuration au préfet, qui en accuse réception. La composition du dossier de demande d’indemnisation est fixée par arrêté du ministre chargé de l’environnement.

Les personnes mentionnées au premier alinéa ont la possibilité de grouper leur demande pour une ou plusieurs parcelles les concernant.

S’il estime que la demande est incomplète, le préfet invite les demandeurs à compléter leur dossier. Lorsque celui-ci est complet, le préfet en accuse réception et le transmet au ministre chargé de l’environnement, en vue de la saisine de la Commission nationale d’expertise prévue à l’article R. 424-12. Le préfet accompagne cette transmission d’observations, comportant une appréciation sur les renseignements et déclarations figurant dans le dossier.

A l’occasion de l’accusé de réception, le préfet informe le demandeur de la transmission de son dossier au ministre, de la teneur de ses observations ainsi que de la procédure devant conduire à la décision prévue à l’article R. 424-14.
