Article R4626-31 of the French Labour Code

The medical examinations provided for in this sub-section are :

1° At the expense of the establishment when it has an independent occupational health and prevention service or when it is linked by agreement to a service shared by several administrations. The establishment provides the occupational physician with the means to ensure that the examinations remain anonymous. Insofar as these examinations cannot be carried out in the establishment, the occupational health physician chooses the body responsible for carrying them out;

2° At the expense of the inter-company occupational health and prevention service when the establishment uses this structure, unless otherwise stipulated in the agreement signed with the inter-company occupational health and prevention service.

Les examens médicaux prévus à la présente sous-section sont :

1° A la charge de l’établissement lorsqu’il dispose d’un service autonome de prévention et de santé au travail ou lorsqu’il est lié par convention à un service commun à plusieurs administrations. L’établissement fournit au médecin du travail le moyen d’assurer le respect de l’anonymat des examens. Dans la mesure où ces examens ne peuvent être réalisés dans l’établissement, le médecin du travail choisit l’organisme chargé de les pratiquer ;

2° A la charge du service de prévention et de santé au travail interentreprises lorsque l’établissement fait appel à cette structure, sauf clause contraire figurant dans la convention signée avec le service de prévention et de santé au travail interentreprises.
