To be considered as representative within the meaning of I of Article L. 513-3 of the Insurance Code, the professional association must have paid-up members representing at least 10% of the total number of professionals subject to compulsory membership, or at least 5% when the association is also recognised as representative under III of Article L. 541-4 of the Monetary and Financial Code or Article R. 519-54 of the Monetary and Financial Code.
The total number of professionals required to be members of the association is determined on the basis of data provided by the body referred to in Article L. 512-1, available at 31 December of the previous year and published in its annual report.
If the representativeness criterion has not been met by the date the application for authorisation is submitted, the association shall submit to the Autorité de contrôle prudentiel et de résolution an operational plan specifying the steps it undertakes to take in order to meet this criterion at the end of a two-year period and including an intermediate quantified target at the end of a one-year period.
The Autorité de contrôle prudentiel et de résolution may grant authorisation if it considers that the plan is likely to enable the association to meet the representativeness criterion at the end of the two-year period. If the numerical target is not met at the end of the one-year period, the AMF will notify the association. It will withdraw approval if the representativeness criterion is not met at the end of the two-year period.
