Article R521-1 of the French Insurance Code

I.- Pursuant to I of Article L. 521-2, the distributor shall provide the subscriber with the contact details and address of its complaints department, where one exists, and shall inform the subscriber of the procedures for recourse to a mediation process under the conditions laid down in Title I of Book VI of the Consumer Code. The distributor will also provide the contact details and address of the Autorité de contrôle prudentiel et de résolution.

II – Before concluding an insurance contract, the insurance intermediary shall inform the prospective policyholder or subscriber of any direct or indirect holding equal to or greater than 10% of the voting rights or capital of an insurance undertaking that it owns. The intermediary shall also inform the AMF of any direct or indirect holding of more than 10% of the voting rights or capital of a given insurance undertaking or of the parent undertaking of a given insurance undertaking.

Any intermediary who carries on business in accordance with the procedures set out in c of II of Article L. 521-2 must also inform the prospective policyholder or member of the name of the insurance undertaking or insurance group with which it recorded more than 33% of the total premium income from its distribution business over the previous year in respect of its intermediary business.

Article R521-1

I.-En application du I de l’article L. 521-2, le distributeur fournit au souscripteur ou à l’adhérent les coordonnées et l’adresse de son service de réclamation, quand il existe, et lui indique les modalités de recours à un processus de médiation dans les conditions prévues au titre Ier du livre VI du code de la consommation . Le distributeur lui fournit également les coordonnées et l’adresse de l’Autorité de contrôle prudentiel et de résolution.

II.-L’intermédiaire d’assurance indique au souscripteur éventuel ou à l’adhérent éventuel, avant la conclusion d’un contrat d’assurance, toute participation, directe ou indirecte, égale ou supérieure à 10 % des droits de vote ou du capital d’une entreprise d’assurance qu’il détient. Il lui indique également toute participation, directe ou indirecte, supérieure à 10 % des droits de vote ou de son capital détenue par une entreprise d’assurance déterminée ou par l’entreprise mère d’une entreprise d’assurance déterminée.

Tout intermédiaire qui exerce selon les modalités prévues au c du II de l’article L. 521-2 indique également au souscripteur éventuel ou à l’adhérent éventuel le nom de l’entreprise d’assurance ou du groupe d’assurance avec lequel il a enregistré au cours de l’année précédente un chiffre d’affaires, au titre de son activité d’intermédiaire, supérieur à 33 % du chiffre d’affaires total qu’il a réalisé au titre de l’ensemble de son activité de distribution.
