Article R6123-121 of the French Public Health Code

I.-The medical care and rehabilitation authorisation is exercised according to the following terms and conditions:

1° “Multi-purpose”;

2° “Geriatrics”;

3° “Locomotor”;

4° “Nervous system”;

5° “Cardiovascular”;

6° “Pneumology”;

7° “Digestive system, endocrinology, diabetology, nutrition”;

8° “Burns”;

9° “Addictive behaviours”;

10° “Paediatrics” comprising the following fields:

a) “Children and adolescents” section;

b) “Young children, children and adolescents” section;

11° “Cancer” section comprising the following sections:

a) “Oncology” section;

b) “Oncology and haematology” section.

II.Only holders of the “children and adolescents” authorisation are authorised to provide care for minors aged 4 and over.

III.- Holders of the “young children, children and adolescents” authorisation are authorised to provide care for minors under the age of 4, in addition to the care provided for in II.

IV.- Holders of the “burns” authorisation are authorised to provide care for minors, by entering into an agreement with a holder of the “young children, children and adolescents” authorisation.

V.- As an exception to II, any holder of a medical care and rehabilitation authorisation may take charge of a minor from the age of 16, in agreement with the holder of parental authority, who must first obtain the child’s opinion. The holder of the authorisation must inform the regional health agency.

I.-L’autorisation de soins médicaux et de réadaptation est exercée suivant les modalités et mentions suivantes :


1° Mention “ polyvalent ” ;


2° Mention “ gériatrie ” ;


3° Mention “ locomoteur ” ;


4° Mention “ système nerveux ” ;


5° Mention “ cardio-vasculaire ” ;


6° Mention “ pneumologie ” ;


7° Mention “ système digestif, endocrinologie, diabétologie, nutrition ” ;


8° Mention “ brûlés ” ;


9° Mention “ conduites addictives ” ;


10° Modalité “ pédiatrie ” comprenant les mentions suivantes :


a) Mention “ enfants et adolescents ” ;


b) Mention “ jeunes enfants, enfants et adolescents ” ;


11° Modalité “ cancers ” comprenant les mentions suivantes :


a) Mention “ oncologie ” ;


b) Mention “ oncologie et hématologie ”.


II.-Seuls les titulaires de l’autorisation “ enfants et adolescents ” sont autorisés à la prise en charge des mineurs de 4 ans et plus.


III.-Les titulaires de l’autorisation “ jeunes enfants, enfants et adolescents ” sont autorisés, outre à la prise en charge prévue au II, à la prise en charge des mineurs de moins de 4 ans.


IV.-Les titulaires de l’autorisation “ brûlés ” sont autorisés à la prise en charge des mineurs, en passant convention avec un titulaire de l’autorisation “ jeunes enfants, enfants et adolescents ”.


V.-Par exception au II, tout titulaire de l’autorisation de soins médicaux et de réadaptation peut prendre en charge un mineur à partir de 16 ans, en accord avec le titulaire de l’autorité parentale qui doit préalablement recueillir l’avis de l’enfant. Le titulaire de l’autorisation en informe l’agence régionale de santé.
