Article R6123-151 of the French Public Health Code

I. – The type of patients cared for, adults or children and adolescents, is specified in the application for authorisation and mentioned in the authorisation decision.

If the authorisation decision refers only to the care of adult patients, the holder is not authorised to care for children and adolescents. Conversely, if the authorisation decision refers only to the care of children and adolescents, the holder of the authorisation is not authorised to care for adult patients.

II. – Exceptionally, depending on the needs for care, the holder of an authorisation allowing the care of adult patients may admit minors aged sixteen and over.

Exceptionally and temporarily, in order to ensure continuity of care, the holder of an authorisation for the care of children and adolescents may continue to care for them after they have reached the age of majority if their state of health so warrants.

I. – Le type de patients pris en charge, adultes ou enfants et adolescents, est précisé dans la demande d’autorisation et mentionné dans la décision d’autorisation.

Si la décision d’autorisation mentionne uniquement la prise en charge de patients adultes, son titulaire n’est pas autorisé à prendre en charge des patients enfants et adolescents. A l’inverse, si elle mentionne uniquement la prise en charge de patients enfants et adolescents, son titulaire n’est pas autorisé à prendre en charge des patients adultes.

II. – A titre exceptionnel, en fonction des besoins de prise en charge, le titulaire d’une autorisation permettant la prise en charge de patients adultes peut accueillir des patients mineurs âgés de seize ans et plus.

A titre exceptionnel et transitoire, afin d’assurer la continuité des soins, le titulaire d’une autorisation permettant la prise en charge de patients enfants et adolescents peut continuer à les prendre en charge après leur majorité lorsque leur état de santé le justifie.
