Article R6123-94 of the French Public Health Code

I-Treatment of cancer by systemic medicinal treatments for cancer consists, within the authorised site :

1° The development of a therapeutic proposal in a multidisciplinary consultation meeting, following the initial diagnosis but also on the occasion of reassessment assessments;

2° The therapeutic decision on systemic cancer drug treatment, regardless of the method of administration, taken during a one-to-one interview by a prescribing doctor, as well as any decision, taken under the same conditions, to make significant changes to this treatment during the patient’s episode of care linked to a change of molecules or the extension of treatment. These therapeutic decisions or significant changes consist of the initial prescription of systemic cancer drug treatment for the patient, in compliance with the provisions of 1° of article R. 6123-91-1;

3° Carrying out systemic cancer drug treatment. In the case of oral medicinal treatments dispensed in dispensing pharmacies and taken by the patient at home, the holder has an organisation for liaising with dispensing pharmacies to support the patient throughout his treatment;

4° For holders of the B and C grades, the management of foreseeable aplasia lasting more than eight days induced by intensive chemotherapy;

5° Patient follow-up during treatment and after the episode of systemic cancer drug treatment.

II-Per derogation to I, the holder of the authorisation for systemic medicinal treatments for cancer may, within the framework of its agreement or its formalised organisation with an associated establishment established under the conditions provided for in II of article R. 6123-90-1, provide for an organisation that allows decisions to be made to significantly change systemic cancer drug treatments on the site of the associated establishment, for patients already referred by it and on condition that these significant changes in treatment are carried out as part of an advanced consultation or teleconsultation with a member of the team of the holder of the authorisation for systemic cancer drug treatments.

Article R6123-94

I-Le traitement du cancer par traitements médicamenteux systémiques du cancer consiste, au sein du site autorisé :

1° A l’élaboration d’une proposition thérapeutique en réunion de concertation pluridisciplinaire, suite au diagnostic initial mais aussi à l’occasion des bilans de réévaluation ;

2° A la décision thérapeutique d’un traitement médicamenteux systémique du cancer, quel que soit son mode d’administration, prise lors d’un entretien singulier par un médecin prescripteur, ainsi qu’à la décision éventuelle, prise dans les mêmes conditions, de changements significatifs de ce traitement pendant l’épisode de soins du patient liée à un changement de molécules ou à la prolongation du traitement. Ces décisions thérapeutiques ou changements significatifs consistent en la primo-prescription du traitement médicamenteux systémique du cancer pour le patient, dans le respect des dispositions du 1° de l’article R. 6123-91-1 ;

3° A la réalisation du traitement médicamenteux systémique du cancer. S’agissant des traitements médicamenteux oraux dispensés en officine de ville et pris par le patient à domicile, le titulaire dispose d’une organisation relative à ses liaisons avec la médecine de ville pour l’accompagnement du patient tout au long de son traitement ;

4° Pour le titulaire avec la mention B et C, à la réalisation de la prise en charge de l’aplasie prévisible de plus de huit jours induite par la chimiothérapie intensive ;

5° Au suivi du patient pendant le traitement et après l’épisode de soins de traitement médicamenteux systémique du cancer.

II-Par dérogation au I, le titulaire de l’autorisation de traitements médicamenteux systémiques du cancer peut, dans le cadre de sa convention ou de son organisation formalisée avec un établissement associé établie dans les conditions prévues au II de l’article R. 6123-90-1, prévoir une organisation permettant des décisions de changement significatif de traitements médicamenteux systémiques du cancer sur le site de l’établissement associé, pour des patients déjà orientés par lui et à la condition que ces changements significatifs de traitement soient réalisés dans le cadre d’une consultation avancée ou téléconsultation d’un membre de l’équipe du titulaire de l’autorisation de traitements médicamenteux systémiques du cancer.
