Article R6332-10 of the French Labour Code

Skills operators may enter into an agreement with a legal entity to delegate the implementation of some of the decisions relating to the information and services mentioned in 1°, 2°, 3° and 5° of II of article R. 6332-17.

This legal entity may not be a training provider, a training body manager, an employers’ organisation or an employees’ organisation.

The delegation agreement may be concluded at national or territorial level with legal entities other than those mentioned in the previous paragraph within their geographical scope, excluding any professional scope.

The delegation is authorised by the Board of Directors and exercised under its responsibility and control.

This agreement is sent to the Minister responsible for vocational training.

Les opérateurs de compétences peuvent conclure avec une personne morale une convention de délégation de mise en œuvre d’une partie des décisions en matière d’informations et de services mentionnées aux 1°, 2°, 3° et 5° du II de l’article R. 6332-17.

Cette personne morale ne peut être ni un prestataire de formation, ni un gestionnaire d’organisme de formation, ni une organisation d’employeur ou une organisation de salariés.

La convention de délégation peut être conclue au plan national ou territorial avec les personnes morales autres que celles mentionnées à l’alinéa précédent dans leur champ d’application géographique, à l’exclusion de tout champ d’application professionnel.

La délégation est autorisée par le conseil d’administration et exercée sous sa responsabilité et son contrôle.

Cette convention est transmise au ministre chargé de la formation professionnelle.
