Article R6332-8 of the French Labour Code

The agreement to set up a skills operator referred to in the first paragraph of III of Article L. 6332-1-1 determines its professional or cross-industry scope, as well as the conditions for its management. In particular, it lays down:

1° The scope of the powers of the Board of Directors and the terms and conditions under which it takes account of the guidelines, training priorities and conditions for the funding of training initiatives proposed by the joint professional sections or commissions set up under the conditions referred to in 2° ;

2° The method of appointing the bodies responsible for preparing the measures listed in 1° and for implementing the body’s management decisions. To this end, the agreement establishing the body may provide for the existence of joint industry sections or joint committees relating to a broader field, or relating to complementary activities, responsible for proposing to the Board of Directors the training guidelines and priorities for the professional fields concerned.

L’accord de constitution d’un opérateur de compétences mentionné au premier alinéa du III de l’article L. 6332-1-1 détermine son champ d’intervention professionnel ou interprofessionnel, ainsi que les conditions de sa gestion. Il fixe notamment :

1° L’étendue des pouvoirs du conseil d’administration ainsi que les modalités de prise en compte par celui-ci des orientations, priorités de formation et conditions de prise en charge des actions de formation proposées par les sections paritaires professionnelles ou les commissions constituées dans les conditions mentionnées au 2° ;

2° Le mode de désignation des organes chargés de la préparation des mesures énumérées au 1° et de l’exécution des décisions de gestion de l’organisme. L’accord de constitution peut prévoir à cet effet l’existence de sections paritaires professionnelles de branches ou de commissions paritaires afférentes à un champ plus large, ou relatives aux activités complémentaires, chargées de proposer au conseil d’administration les orientations et priorités de formation pour les champs professionnels concernées.
