Article R814-166 of the French Commercial code

Each société de participations financières de professions libérales d’administrateurs judiciaires ou de mandataires judiciaires is subject, at least once every three years, to an audit covering compliance with the legislative and regulatory provisions governing the composition of its capital and the scope of its activities.

Before the end of each year, the Chairman of the National Council sends the Minister of Justice a list of the companies that the Council’s executive committee has designated for periodic inspection during the following year. This list is also sent to the Government Commissioner of the Registration and Disciplinary Committee that registered them and to the coordinating magistrate mentioned in Article R. 811-40.

Each financial holding company may, in addition, be subject to occasional controls, prescribed in accordance with the first paragraph of article R. 814-42-2.

The provisions of articles R. 814-44 to R. 814-46, with the exception of the sixth paragraph of article R. 814-45, and the second paragraph of article R. 814-48 are applicable to these controls.

Chaque société de participations financières de professions libérales d’administrateurs judiciaires ou de mandataires judiciaires fait l’objet, au moins une fois tous les trois ans, d’un contrôle portant sur le respect des dispositions législatives et réglementaires qui régissent la composition de son capital et l’étendue de ses activités.

Avant la fin de chaque année, le président du conseil national adresse au garde des sceaux, ministre de la justice, la liste des sociétés que le bureau du conseil a désignées comme devant faire l’objet du contrôle périodique au cours de l’année suivante. Cette liste est également adressée au commissaire du Gouvernement près de la commission d’inscription et de discipline qui a procédé à leur inscription ainsi qu’au magistrat coordonnateur mentionné à l’article R. 811-40.

Chaque société de participations financières peut, en outre, être soumise à des contrôles occasionnels, prescrits conformément au premier alinéa de l’article R. 814-42-2.

Les dispositions des articles R. 814-44 à R. 814-46, à l’exception du sixième alinéa de l’article R. 814-45, et du deuxième alinéa de l’article R. 814-48 sont applicables à ces contrôles.
