Article 728-20 of the French Code of Criminal Procedure

When the sentenced person is on the territory of the executing State, the public prosecutor may ask the competent authority of that State, when forwarding the sentencing decision and the certificate, to provisionally arrest the sentenced person or to take any measure to ensure that he or she remains on the territory of that State pending the decision on recognition and enforcement.

In urgent cases, if the representative of the Public Prosecutor’s Office is unable to send the certificate to the competent authority of the executing State, he shall send it the information mentioned in 1° to 6° of l’article 728-12.

Article 728-20

Lorsque la personne condamnée se trouve sur le territoire de l’Etat d’exécution, le ministère public peut demander à l’autorité compétente de cet Etat, lors de la transmission de la décision de condamnation et du certificat, de procéder à l’arrestation provisoire de la personne condamnée ou de prendre toute mesure permettant d’assurer son maintien sur le territoire de cet Etat dans l’attente de la décision de reconnaissance et d’exécution.

En cas d’urgence, si le représentant du ministère public n’est pas en mesure d’adresser le certificat à l’autorité compétente de l’Etat d’exécution, il lui transmet les informations mentionnées aux 1° à 6° de l’article 728-12.
