Article 728-21 of the French Code of Criminal Procedure

When the representative of the public prosecutor is consulted by the competent authority of the executing State on partial recognition of the sentencing decision, he or she shall examine whether an agreement can be reached, after considering the possible arrangements for such a solution in conjunction with that authority.

Partial enforcement of the sentence may not result in an increase in the length of the custodial sentence or detention order.

If the representative of the Public Prosecutor approves the proposed terms of partial enforcement, he will give his consent. Otherwise, he withdraws the certificate.

Lorsque le représentant du ministère public est consulté par l’autorité compétente de l’Etat d’exécution sur une reconnaissance partielle de la décision de condamnation, il examine, après avoir envisagé en lien avec cette autorité les modalités possibles d’une telle solution, si un accord peut être trouvé.


L’exécution partielle de la décision de condamnation ne peut avoir pour conséquence d’accroître la durée de la peine ou de la mesure de sûreté privative de liberté.


S’il approuve les modalités d’exécution partielle envisagées, le représentant du ministère public donne son accord. Dans le cas contraire, il retire le certificat.
