Article 728-22-1 of the French Code of Criminal Procedure

The sentenced person may challenge the decision of the representative of the public prosecutor’s office before the president of the enforcement division of the court of appeal:

1° To automatically forward a sentencing decision to the competent authority of another European Union Member State for enforcement pursuant to the third paragraph of Article 728-15 ;

<2° Refusal to forward such a decision in application of the same third paragraph, despite a request to this effect from the offender;

3° Withdrawal of the certificate issued in application of the first paragraph of article 728-22.

This appeal has suspensive effect.

The file or a copy of it is then sent by the representative of the public prosecutor to the president of the enforcement division of the court of appeal within whose jurisdiction the court that handed down the sentencing decision is located.

The president rules, after having received the written observations of the representative of the public prosecutor’s office and the convicted person, in a reasoned order that is not subject to appeal.

La personne condamnée peut contester devant le président de la chambre de l’application des peines de la cour d’appel la décision du représentant du ministère public :


1° De transmission d’office à l’autorité compétente d’un autre Etat membre de l’Union européenne d’une décision de condamnation aux fins d’exécution en application du troisième alinéa de l’article 728-15 ;


2° De refus de transmettre une telle décision en application du même troisième alinéa, malgré la demande en ce sens du condamné ;


3° De retrait du certificat pris en application du premier alinéa de l’article 728-22.


Ce recours est suspensif.


Le dossier ou sa copie est alors transmis par le représentant du ministère public au président de la chambre de l’application des peines de la cour d’appel dans le ressort de laquelle se trouve la juridiction ayant prononcé la décision de condamnation.


Le président statue, après avoir recueilli les observations écrites du représentant du ministère public et de la personne condamnée, par une ordonnance motivée qui n’est pas susceptible de recours.
