Article 728-33 of the French Code of Criminal Procedure

Enforcement of the sentencing decision may be refused in the following cases:

1° The sentencing decision is based on offences committed wholly, mainly or for the most part on French territory or in an assimilated place;

2° The length of the sentence remaining to be served is less than six months on the date of receipt of the certificate;

3° The sentencing State has refused to give its consent for the sentenced person to be prosecuted, sentenced or deprived of liberty in France for an offence committed prior to his transfer, other than that for which he was transferred.

L’exécution de la décision de condamnation peut être refusée dans les cas suivants :


1° La décision de condamnation est fondée sur des infractions commises en totalité, en majeure partie ou pour l’essentiel sur le territoire français ou en un lieu assimilé ;


2° La durée de la peine restant à exécuter est inférieure à six mois à la date de réception du certificat ;


3° L’Etat de condamnation a refusé de donner son consentement à ce que la personne condamnée puisse être poursuivie, condamnée ou privée de liberté en France pour une infraction commise avant son transfèrement, autre que celle ayant motivé celui-ci.
