Article 728-61 of the French Code of Criminal Procedure

If the sentenced person is on the territory of the sentencing State, he or she will be transferred to French territory on a date set by the Minister of Justice in agreement with the competent authority of that State, no later than thirty days from the date on which the decision to recognise the sentence and enforce the custodial sentence or detention order becomes final.

If transfer is impossible within this time limit due to unforeseen circumstances, the Minister for Justice and the competent authority of the sentencing State shall agree on a new transfer date as soon as these circumstances have ceased. The transfer shall take place, at the latest, within ten days of this new date.

Si la personne condamnée se trouve sur le territoire de l’Etat de condamnation, elle est transférée sur le territoire français à une date fixée par le ministre de la justice en accord avec l’autorité compétente de cet Etat, au plus tard trente jours à compter de la date à laquelle la décision de reconnaître la condamnation et d’exécuter la peine ou la mesure de sûreté privative de liberté a acquis un caractère définitif.


Si le transfèrement est impossible dans ce délai en raison de circonstances imprévues, le ministre de la justice et l’autorité compétente de l’Etat de condamnation conviennent d’une nouvelle date de transfèrement dès que ces circonstances ont cessé. Le transfèrement a lieu, au plus tard, dans les dix jours suivant cette nouvelle date.
