Article D125-1-1 of the French Insurance Code

The rules governing the right to communication of administrative documents on which decisions are based to recognise or not to recognise a municipality as being in a state of natural disaster are laid down by the provisions of Chapter I of Title I of Book III of the Code of Relations between the Public and the Administration.

The procedures for communicating administrative documents, in particular expert reports, on which these decisions are based, are mentioned in the order referred to in the fourth paragraph of article L. 125-1 or in its appendices. They indicate in particular the administrative department to which the request for communication must be made.

Les règles encadrant le droit à communication des documents administratifs qui ont fondé les décisions de reconnaissance ou de non-reconnaissance des communes en état de catastrophe naturelle sont fixées par les dispositions du chapitre I du titre I du livre III du code des relations entre le public et l’administration.


Les modalités de communication des documents administratifs, notamment des rapports d’expertise, qui ont fondé ces décisions, sont mentionnées dans l’arrêté visé au quatrième alinéa de l’article L. 125-1 ou dans ses annexes. Ils indiquent notamment le service administratif auprès duquel la demande de communication doit être formulée.
